On 24 June 2020, the National Council of Provinces (NCOP) was due to vote on the Civil Union Amendment Bill, but the vote was postponed to 1 July 2020.
The Bill proposes to take away the rights of Home Affairs employees to conscientiously object to solemnising “same sex marriage.”
It is a cause for concern especially as it’s in the mould of similar international initiatives, and would establish a precedent. One could then raise the question about all the doctors, nurses, and other health-care providers and their right to oppose participation in abortion, euthanasia and the like…
The Bill has already passed through the House of Assembly and with its approval by the NCOP, it only remains to be signed into law. Without significant pressure from the public, the Bill will pass…
This Bill does not affect “religious marriage officers” who function in terms of the Marriage Act. Consequently, they cannot be forced to perform “same-sex marriages.” But if this Bill is passed, the picture could well change dramatically… The reason is that legislation is afoot to amalgamate The Marriage Act, The Civil Union Act and The Customary Marriages Act.
It is a hallmark of any civilized and democratic society that citizens should not be obliged to violate their most basic convictions – be these of an ethical, religious or moral nature. And where morally pernicious legislation has been foisted upon a nation, there must be provision made for those, who in conscience, cannot fulfil tasks inherent to such legislation!

My Petition Message To:
Chairperson, Speaker and Members of the NCOP
I hereby register the strongest possible opposition to the proposed amendment to the Civil Union Act, which amendment would eliminate the conscience clause currently allowing marriage officers the right to conscientiously object to solemnising same sex “marriages.”
The proposed Bill, would if successful, legally force these civil marriage officers to simply violate their consciences! This would be a grave injustice. It is a matter of great concern especially as it would set a precedent for riding roughshod over an individual’s conscience in other critical areas of social life.
It is a hallmark of any civilized and democratic society that citizens should not be obliged to violate their most basic convictions – be these of an ethical, religious or moral nature. And where morally objectionable legislation has been foisted upon a nation, there must be provision made for those, who in conscience, cannot fulfil tasks inherent to such legislation! Regardless of the legality of same-sex “marriage,” it remains, for a sizable portion of the public, a “moral wrong.” No one should be forced to accept a moral wrong, participate in it, or serve as an accomplice in its execution.
In my humble opinion this bill should not have made it through Parliament and I respectfully request that it be rejected by the NCOP and thrown out with the contempt it deserves!
